Terms of Service
Last updated: 17 September 2026Effective from: 17 September 2026Version 2026-09-17
These Terms of Service (“Terms”) govern access to and use of RemiXiss at https://rmxvisual.pl, including photographer accounts, client galleries, storage, subscriptions and related features.
The Service Provider is Oliwier Zaremba – RMXVisual, a natural person operating RemiXiss. The Service Provider is not described as an incorporated legal entity.
1. General provisions
By creating a photographer account, purchasing a paid plan, or otherwise using RemiXiss as a photographer, you enter into a contract with the Service Provider on these Terms.
Gallery viewers are not photographer account holders. Their use of a client gallery is also subject to the Gallery Viewer Terms.
If you are a consumer, mandatory consumer-protection rules of Polish and European Union law prevail over any contractual limitation that would otherwise reduce those rights.
2. Definitions
- “Service Provider” means Oliwier Zaremba – RMXVisual.
- “RemiXiss” or the “Service” means the online gallery platform available at https://rmxvisual.pl.
- “Photographer” or “Customer” means a person who registers a RemiXiss account to create and deliver galleries.
- “Client” or “Viewer” means a person who accesses a gallery created by a Photographer.
- “Content” means photographs, media, text, credentials, branding assets and other material uploaded or configured by a Photographer.
- “Usage period” means the current billing period for Stripe-billed accounts, or the current UTC calendar month for accounts without an active Stripe billing period.
3. Service Provider identification
The Service Provider of RemiXiss is:
Oliwier Zaremba – RMXVisual Górnośląska 21A 62-800 Kalisz Poland kontakt@rmxvisual.pl
No tax identification number, company registration number or incorporated legal form is stated in these Terms because none has been supplied for publication. Correspondence and complaints may be sent by email or post using the details above.
4. Scope and description of RemiXiss
RemiXiss is a SaaS platform for photographers. It allows Photographers to create accounts, create client photo galleries, upload photographs and media, protect galleries with credentials, allow Clients to view and download photos, customise gallery branding and backgrounds, subscribe to Free, Pro or Pro+ plans, view gallery statistics, and manage client-facing delivery pages.
RemiXiss is a technical delivery platform. The Photographer controls gallery content and the purpose for which photographs are shared with Clients.
5. Electronic service provision
RemiXiss is provided as an electronic service over the internet. The contract for a photographer account is concluded when registration is completed. The contract for a paid plan is concluded when the subscription is successfully confirmed by Stripe.
6. Technical requirements
Use of RemiXiss requires a current web browser, a stable internet connection and, for Photographers, a valid email address. Some features require JavaScript. The Service is designed for modern desktop and mobile browsers.
7. Account registration
Photographer accounts are created with an email address, password and display name. Registration requires explicit agreement to these Terms and acknowledgement that the Privacy Policy has been read. That acknowledgement is not GDPR consent.
You must provide accurate account information and keep it current. One person should not create accounts to evade limits, security controls or a suspension.
8. Account security
You are responsible for keeping your password confidential and for activity carried out through your account, except where unauthorised use results from a failure attributable to the Service Provider.
Notify the Service Provider without undue delay at the contact email if you suspect unauthorised access.
9. Photographer responsibilities
You are responsible for the Content you upload and for the galleries you create, including how you share access with Clients.
You must have sufficient rights and a lawful basis for the material you upload. That may include copyright, image rights, contractual rights, privacy and data-protection obligations, and any permission required to share client images.
This clause does not transfer every conceivable legal risk to Photographers, and it does not exclude liability that cannot be excluded under applicable law.
10. Client galleries
Photographers may create galleries, set names and appearance, publish or keep drafts, and choose public access or login-protected access.
Draft galleries are not shown to Clients as published galleries. A Client following an unpublished link may receive a not-found response until the gallery is published.
11. Gallery access credentials
Photographers may create gallery-specific login and password credentials for Clients. Those credentials are intended for authorised viewers of that gallery. They do not create a full RemiXiss photographer account.
Photographers decide who should receive credentials and how strictly a gallery should be protected. Viewers should not redistribute private gallery URLs or credentials without authorisation. Unauthorised sharing may expose private photographs.
12. User-generated content
Galleries, photographs, branding, backgrounds, client identifiers and related metadata are user-generated content supplied by the Photographer. The Service Provider hosts and processes that content to operate RemiXiss.
13. Photographs and intellectual property
Photographers retain ownership and intellectual-property rights in uploaded photographs and other Content. Uploading Content does not transfer ownership to RemiXiss, RMXVisual or the Service Provider.
14. Ownership of uploaded content
Except for the limited licence in section 15, all rights in Photographer Content remain with the Photographer or the underlying rights-holder.
15. Limited licence required to operate RemiXiss
You grant the Service Provider a limited, non-exclusive, worldwide licence to host, store, process, resize, generate previews and thumbnails, transmit, display to authorised users, enable downloads, and otherwise technically provide RemiXiss.
This licence exists only to operate and provide the Service. It does not permit the Service Provider to exploit your photographs independently of providing RemiXiss.
16. Prohibited and unlawful content
You may not use RemiXiss for content or activity that is unlawful, infringing, malicious, malware-related, intended to compromise accounts or systems, uploaded without necessary rights or legal basis, or used to circumvent security controls.
The Service Provider may restrict or remove access to content where reasonably necessary because of law, a valid legal request, security risk, an infringement complaint, malware or abuse, or a breach of these Terms. This is not an unlimited right to reuse or commercially exploit your photographs.
17. Storage
Production media is stored in Cloudflare R2 object storage. Photo and gallery metadata is stored in PostgreSQL hosted on Supabase infrastructure. The application is hosted on Vercel. Local disk folders used in development are not production user storage.
Generated thumbnails, previews and similar derivatives do not count toward source quota. They may still consume infrastructure storage.
18. Storage quotas
Free includes 1 GB of current quota-counted source storage per project. Pro includes 3 GB per project. Pro+ includes 10 GB per project.
Quota is measured against source/original file size as implemented in RemiXiss (binary gigabytes, labelled “GB” in the product). Deleting source files may reduce current project storage usage.
19. Project limits
Free accounts may create up to 10 new projects per usage period. Pro accounts may create up to 25 new projects per usage period. Pro+ has no new-project creation cap.
Project-creation counters reset when a new usage period starts. Existing projects are not deleted when the counter resets. Deleting a project does not refund the historical project-created counter for that period.
20. Free / Pro / Pro+ plans
Free — “No pressure. Start sharing.”: up to 10 newly created projects per usage period; 1 GB source storage per project; RemiXiss branding remains visible.
Pro — “For photographers who mean business.”: up to 25 newly created projects per usage period; 3 GB source storage per project; RemiXiss branding remains visible.
Pro+ — “Replace the drives on your desk. RemiXiss steps aside — your brand takes over.”: unlimited newly created projects; 10 GB source storage per project; 100 GB of new user-uploaded source data per usage period; white-label client galleries.
Pro+ uploaded-byte usage is historical for the period: deleting files does not refund historical Pro+ uploaded-byte usage for that period.
21. Paid subscriptions
Pro and Pro+ are recurring monthly subscriptions. The applicable price is shown before purchase. Subscriptions renew automatically each billing interval until cancelled.
22. Billing
Paid plans are billed through Stripe. Stripe issues receipts/invoices according to its billing records. RemiXiss stores subscription and customer identifiers and related billing metadata, not full card numbers.
Displayed prices may be exclusive or inclusive of tax depending on Stripe Tax configuration and the payer’s location. Where tax is due, it is collected according to the payment processor’s checkout presentation.
23. Stripe payment processing
Stripe is the payment processor. Card data is handled by Stripe. RemiXiss does not store full payment card numbers.
24. Automatic renewal
Paid subscriptions renew automatically at the end of each monthly billing interval until cancelled. Renewal charges the then-current subscription price for the selected plan unless a change has already been confirmed in Stripe.
25. Subscription cancellation
You may cancel through the RemiXiss billing controls or the Stripe customer portal. Cancellation is scheduled at period end. The paid plan remains active until the current billing period ends. After that, the account switches to Free. Existing galleries are not automatically deleted solely because the plan returns to Free, but Free limits then apply to new projects and storage.
26. Upgrades and downgrades
Upgrades or switches between paid plans on an existing Stripe subscription are applied by Stripe with proration. Downgrading from a paid plan to Free is a cancellation at period end, not an immediate feature removal.
27. Failed payments
If a payment is past due, existing galleries remain online and the account may keep paid limits while Stripe retries or awaits updated payment details. If the subscription becomes unpaid or cancelled, a Stripe-billed account returns to Free. Update payment details promptly to avoid interruption of paid limits.
28. Refund rules
RemiXiss does not operate an automatic in-app refund button. Refund requests may be sent to the contact email and are assessed case by case, including any statutory consumer refund or withdrawal rights.
Nothing in these Terms excludes a refund or price reduction required by mandatory law.
29. Consumer statutory rights
If you are a consumer, you keep all rights that cannot legally be waived, including rights under Polish and EU consumer law. Contractual limitations apply only to the extent permitted.
30. Right of withdrawal where applicable
Consumers may have a statutory right of withdrawal from a distance contract. Details, including a model form, are published at https://rmxvisual.pl/withdrawal.
RemiXiss does not treat clicking “Buy” or accepting these Terms as a waiver of the withdrawal right. Where the digital service begins immediately, a separate, unchecked acknowledgement is requested. Beginning performance during the withdrawal period may mean that if you later withdraw, you may be charged for the service actually provided. An ongoing subscription is not described as fully performed at the moment of purchase.
31. Availability
RemiXiss does not guarantee 100% uptime. Availability may be affected by maintenance, infrastructure failures, security incidents, third-party provider outages or other technical failures. This section does not disclaim mandatory statutory obligations.
32. Maintenance
The Service Provider may perform maintenance that temporarily limits access. Where reasonably possible, disruptive maintenance will be kept as short as practicable.
33. Backups and photographer responsibility
Cloudflare R2 is the production object store. It is not described as a separate guaranteed backup or versioning system. Photographers should retain original photographs independently. The Service Provider does not promise that every file is fully backed up or recoverable in every failure scenario.
34. Data deletion
Photographers may delete galleries and source files from their account. Deleting a gallery removes that gallery’s stored media objects as implemented by the current deletion process. Residual copies may remain for a limited time in infrastructure caches or provider-side snapshots that RemiXiss does not independently control.
There is currently no complete self-service “delete my entire RemiXiss account” control. Account-closure requests may be sent to the contact email. Billing, security and accounting records may be retained as required by law.
35. Account termination
You may stop using RemiXiss at any time and cancel a paid subscription as described above. The Service Provider may terminate or refuse the service where required by law or in the cases described in the suspension section.
36. Suspension
The Service Provider may suspend an account where reasonably necessary for security, abuse, unpaid subscription where paid access is no longer due, or a serious Terms violation. Suspension is a platform control; it is not a substitute for statutory procedures.
37. Abuse, security and legal violations
Attacks, credential stuffing, scraping that bypasses access controls, automated abusive downloading, malware, and attempts to compromise RemiXiss or other users are prohibited.
38. Complaints
Complaints may be submitted electronically to the contact email, or by post to the Service Provider’s address. Please include your account email, a gallery or project reference where relevant, a description of the problem, the resolution sought, and supporting information.
Oliwier Zaremba – RMXVisual Górnośląska 21A 62-800 Kalisz Poland kontakt@rmxvisual.pl
The Service Provider will consider complaints without undue delay. Where consumer law imposes a mandatory response period, that period applies. No shorter contractual deadline is imposed in place of a longer statutory period.
39. Liability
The Service Provider is liable for performance of the Service in accordance with these Terms and applicable law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for wilful misconduct, or for any other liability that cannot legally be excluded.
Subject to the previous sentence and to mandatory consumer protections, the Service Provider is not liable for loss that was not reasonably foreseeable, for loss caused by the Photographer’s Content or access decisions, or for failures of third-party infrastructure outside the Service Provider’s reasonable control, except where Polish or EU law provides otherwise.
40. Force majeure
Neither party is responsible for failure to perform caused by events beyond reasonable control, including widespread infrastructure outages, war, natural disaster, or government action, for as long as those events prevent performance. This does not affect mandatory consumer rights.
41. Changes to the Terms
The current Terms version is 2026-09-17. Material changes will be published at this URL with a new version identifier. RemiXiss can detect that a Photographer accepted an older version and may request new acceptance. Existing accounts are not silently marked as having accepted a new version.
42. Governing law
These Terms are governed by the law of Poland, without prejudice to mandatory consumer protections that apply in the consumer’s country of residence.
43. Mandatory consumer protections
Mandatory consumer protections prevail over contractual limitations. If a term would be invalid in a consumer contract, it is modified to the minimum extent required, or disapplied, and the remaining Terms continue.
